Fighteck Terms & Conditions:

Welcome to Fighteck LTD, part of 2U, Inc. We are “Fighteck,” “we,” or “us.” These Terms of Service govern your use of our website, hosted apps, and services (“Service”). Using the Service means you agree to these legally binding terms.

Read these terms carefully. Creating an Account or accessing the Service means you understand and accept these Terms, including the Privacy Policy. If you don’t meet eligibility or disagree, you can’t use the Service. Using the Service forms a binding agreement with Fighteck to follow these Terms.

Arbitration Notice: Disputes are resolved through individual arbitration except for certain disputes mentioned in Section 18 (Dispute Resolution and Arbitration). By accepting these Terms, you waive trial by jury and class actions.

  1. Fighteck Service Overview.

1.1 Fighteck operates with a mission to provide top-tier online courses. As a user of the Service, you can:

  • Explore our Offerings, which include individual courses (“Courses”), comprehensive sequences of related courses (“Programs”), and additional content that Fighteck, our Members, our parent company 2U, Inc., and its subsidiaries (collectively, “2U”), along with 2U’s partners and other non-Member institutions, offer.
  • Register for an Account.
  • Opt to receive detailed information about specific Offerings available through the Service.
  • Purchase or enroll in and gain access to select Offerings through the Service, which may involve a recurring subscription to certain Offerings.
  • Engage actively in the Offerings you have enrolled in, which involves interacting with course material, completing tests, receiving your results and certificates of achievement, and giving feedback after completing an Offering.

    1.2 “Members”.

    Educational entities using Fighteck’s tools provide Offerings through the Service. Completing a Course may earn you a Certificate. Fighteck decides if Certificates are awarded, usually not in the free Audit Track.

    You can access other Offerings on the Fighteck Site, often by non-Member partners or 2U partnerships. When enrolling or participating, you might use third-party sites, including those by 2U, not bound by these Terms.

    1. Miscellaneous.

    19.1 General Terms.

    These Terms, Privacy Policy, Honor Code, and referenced agreements are the exclusive agreement for your Service use. No transfer without our consent; we can transfer anytime. Our non-enforcement doesn’t waive future action. Section headers are for convenience. “Including” means “including but not limited to.” Invalid parts are applied as much as possible; the rest stands.

    19.2 Governing Law.

    These Terms are governed by Maryland law, with exclusive jurisdiction in Prince George’s County, Maryland for allowed legal actions. The Service operates from Maryland and may not be suitable or accessible elsewhere.

    The Privacy Policy, which we update periodically, details how we handle your personal information. We will notify you of material changes through the Fighteck Site or other means. The Privacy Policy is part of these Terms.

    Your use of the Service is subject to all other terms, policies, rules, or guidelines we may provide or link to from the Service (“Additional Terms”), which are part of these Terms.

    By using the Service, you agree to receive electronic communications from us as described in Section 10 (Communications) and the Privacy Policy. You accept that electronic communications we send meet any legal requirement that such communications be in writing.

    We prohibit accessing the Service from countries or territories or by individuals where such access is illegal.

    19.11 Sanctions.

    You warrant that you are not the subject of U.S. sanctions or on any government sanctions list, nor are you prohibited from accessing or paying for the Service due to any U.S. sanctions applicable to you.

    20. Notice Regarding Apple.

    For iOS app users: These Terms are with edX, not Apple. Apple isn’t responsible for the Service or support. If there’s a warranty issue, contact Apple for a refund. Apple has no other warranty obligations. Claims, including product liability, aren’t handled by Apple. You must adhere to third-party terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you.

    1. Limitation of Liability.

    17.1 Fighteck Entities and Other Providers are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, regardless of the legal theory, even if they knew of such damages.

    17.2 Their liability for Service-related claims is limited to (A) your last 12 months’ payments or (B) US $100, as per Sections 18.5 and 18.7.

    17.3 These limits, warranty disclaimers, and damage exclusions allocate risks, are essential, severable, and apply even if remedies fail.

    Dispute Resolution and Arbitration.

    18.1 You and Fighteck agree to resolve disputes through binding arbitration, excluding certain exceptions, using a neutral arbitrator. This agreement remains valid after these Terms end.

    18.2 Exceptions: Small claims court, government agencies, injunctive relief in court, and intellectual property claims in court are not subject to arbitration.

    18.3 Opt-Out: You can opt out of arbitration within 30 days by sending a letter to Fighteck with your name, email, and an opt-out statement.

    18.4 Arbitrator: Arbitration is conducted by the American Arbitration Association under its rules.

    18.5 Starting Arbitration: Initiate arbitration with a written Notice of Arbitration. Fighteck reimburses fees under $10,000, except in multiple consumer cases.

    18.6 Arbitration Proceedings: Hearings are in your county or state or based on AAA Rules.

    18.7 Arbitration Relief: The arbitrator can award court-like relief, and Fighteck pays the higher of the award or $10,000. The award is final, with exceptions.

    18.8 No Class Actions: Claims are in an individual capacity, not as part of a class action.

    18.9 Changes to Arbitration: Reject changes within 30 days to terminate your Account and maintain the prior arbitration provision.

    1. 14.1 Term:

      The Terms begin upon acceptance and end per Section 14.2.

      14.2 Termination:

      Breaking the Terms ends your rights and access. Fighteck can terminate at any time, with or without notice. You can end your Account anytime. After termination, certain sections persist. Backup your content; it becomes inaccessible. Don’t re-register if banned.

      Service changes may occur without notice, with no Fighteck liability. Save your content to avoid loss. “Fighteck Participants” include educational entities and personnel.

    1. Indemnity.

    You’re fully responsible for your Service use and must protect and indemnify Fighteck and its entities from third-party claims, liabilities, expenses, and more, including legal fees, arising from: (a) improper Service use; (b) violating these Terms, agreements, or laws; (c) infringing third-party rights; or (d) disputes.     5.4 Delinquent Accounts.

    Fighteck may suspend or terminate your access to the Service, including the fee-based sections, if your Account has any unpaid amounts. A delinquent Account will incur fees or charges related to any chargeback or the collection of the unpaid amount, including collection fees.

    If your payment method fails when a Subscription Fee is due, and you do not correct the payment issue within any grace period Fighteck may offer, Fighteck may suspend your subscription to the relevant Subscription Offerings. Fighteck may then either unenroll you from all Offerings within that Subscription Offering, causing you to lose any progress if you later re-enroll, or change your enrollment from the Certificate Track to the Audit Track.

    1. Licenses.

    6.1 Limited License.

    As long as you comply with these Terms, Fighteck gives you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license solely for your personal, non-commercial use to: (a) install and use one object code copy of any mobile or other downloadable application linked with the Service on a mobile device you own or control, and (b) access and use the Service. For Materials defined in Section 7 (Ownership; Proprietary Rights) within an Offering, this license limits your use to the Materials as part of that Offering.

    6.2 License Restrictions.

    You may not, unless such a restriction is unlawful under applicable law, (a) copy, distribute, display or perform publicly, or create adaptations of the Service; (b) modify the Service; or (c) disrupt or bypass any Service features, including security or access controls. You grant these rights to Fighteck and Members directly to the audience, meaning external service owners or operators will not owe you or any third party for User Content used on external services via the Service. You commit to paying all monies due to any person or entity because of your User Content and Fighteck’s use of the license in this section.

    9.3 Specific Rules for Musical Works and Recording Artists.

    If you are a composer or author of a musical work and you have given non-exclusive rights to a Performing Rights Organization (PRO), you must inform your PRO of the royalty-free license you grant through these Terms to Fighteck. You must ensure you meet your PRO’s reporting obligations. If a music publisher or PRO holds your rights, you need their consent to grant the royalty-free license these Terms describe, or they must enter these Terms with Fighteck. If you are a recording artist under a record label contract, you must make sure your use of the Service meets your contractual obligations to your label, especially if you create new recordings through the Service that your label may claim. If you plan to perform a cover song and upload it to the Service, you must secure all rights to the underlying musical work before uploading your recording or performance to the Service.

    9.4 You Must Have Rights to the Content You Upload.

    User Content Representations: Only upload content you own or have rights to. Fighteck isn’t liable for User Content. You’re solely responsible. By sharing, you confirm:

    1. Ownership or necessary permissions.
    2. No third-party rights infringement.
    3. Content isn’t objectionable, profane, etc.

    9.5 User Content Disclaimer.

    Fighteck has no obligation to edit or control User Content that users upload and is not liable for User Content. However, Fighteck can at any time remove or block User Content that we think violates these Terms, infringes on third-party rights, or is otherwise objectionable. When using the Service, you may encounter User Content from various sources, which might be inaccurate, offensive, or objectionable.       6.1 Limited License.

      As long as you comply with these Terms, Fighteck gives you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license solely for your personal, non-commercial use to: (a) install and use one object code copy of any mobile or other downloadable application linked with the Service on a mobile device you own or control, and (b) access and use the Service. For Materials defined in Section 7 (Ownership; Proprietary Rights) within an Offering, this license limits your use to the Materials as part of that Offering.

      6.2 License Restrictions.

      You may not, unless such a restriction is unlawful under applicable law, (a) copy, distribute, display or perform publicly, or create adaptations of the Service; (b) modify the Service; or (c) disrupt or bypass any Service features, including security or access controls.       8.2 Third-Party Software

      9.3 Specific Rules for Musical Works and Recording Artists.

      If you are a composer or author of a musical work and you have given non-exclusive rights to a Performing Rights Organization (PRO), you must inform your PRO of the royalty-free license you grant through these Terms to Fighteck. You must ensure you meet your PRO’s reporting obligations. If a music publisher or PRO holds your rights, you need their consent to grant the royalty-free license these Terms describe, or they must enter these Terms with Fighteck. If you are a recording artist under a record label contract, you must make sure your use of the Service meets your contractual obligations to your label, especially if you create new recordings through the Service that your label may claim. If you plan to perform a cover song and upload it to the Service, you must secure all rights to the underlying musical work before uploading your recording or performance to the Service.

      9.4 You Must Have Rights to the Content You Upload.

      User Content Representations: Only upload content you own or have rights to. Fighteck isn’t liable for User Content. You’re solely responsible. By sharing, you confirm:

      9.5 User Content Disclaimer.

      Fighteck has no obligation to edit or control User Content that users upload and is not liable for User Content. When using the Service, you may encounter User Content from various sources, which might be inaccurate, offensive, or objectionable.       12.4 Repeat Infringers:

      We remove or block access to infringing content and may terminate users who repeatedly infringe. We retain the right to suspend or terminate Accounts at our discretion.

      12.5 Counter Notification:

      If notified of content removal, you can send a “Counter Notification” to our Designated Agent with your signature, details of the removed content, a statement under penalty of perjury, and contact information.

      12.6 Content Restoration:

      Upon receipt of a valid Counter Notification, we’ll inform the claimant and restore the content within 10-14 business days unless a court order is obtained.

      12.7 False Notifications:

      Knowingly misrepresenting infringement may result in liability for damages, costs, and attorneys’ fees under 17 U.S.C. § 512(f). Fighteck reserves the right to claim damages for false notifications or counter notifications.

      1. Modification of Terms.

      We may, from time to time, change these Terms. Please check these Terms periodically for changes. We may require that you accept modified Terms to continue to use the Service. If you do not agree to the modified Terms, then you should request deletion of your Account and related personal information by clicking the button labeled “Delete my account” in your Account settings and discontinue your use of the Service.       1. Indemnity.

      You’re fully responsible for your Service use and must protect and indemnify Fighteck and its entities from third-party claims, liabilities, expenses, and more, including legal fees, arising from: (a) improper Service use; (b) violating these Terms, agreements, or laws; (c) infringing third-party rights; or (d) disputes. We can take control of defense, at our cost, if required, and you must assist.

      16.1 Fighteck, 2U, Fighteck Participants, and Other Providers offer the Service and its content “AS IS” and “AS AVAILABLE.” They disclaim all warranties, including implied warranties and do not guarantee uninterrupted, secure, or error-free service.

      16.2 Except for Degree Offerings in Section 4, your participation in Offerings doesn’t grant admission, enrollment, or additional privileges in degree programs.

      16.3 No advice or information from the Service or Fighteck Entities creates warranties beyond these Terms. We’re not liable for any damage or data loss from your use of the Service.

      16.4 These limitations, exclusions, and disclaimers apply to the fullest extent permitted by law and don’t waive any prohibited warranties or rights.

      1. Limitation of Liability.

      18.7 Arbitration Relief: The arbitrator can award court-like relief, and Fighteck pays the higher of the award or $10,000. The award is final, with exceptions.

      18.8 No Class Actions: Claims are in an individual capacity, not as part of a class action.

      18.9 Changes to Arbitration: Reject changes within 30 days to terminate your Account and maintain the prior arbitration provision.

      4.3 Professional licensure and certification requirements differ across states and countries, and employers’ job requirements also vary.

      Fighteck does not ensure that you will obtain licensure, certification, or job qualification upon completing a Degree Offering through the Service. You should research, understand, and meet the requirements in the state or country where you work or plan to work. Before enrolling, verify whether the Degree Offering fulfills your academic or professional needs. Also, consider consulting any resources the Member provides about its Degree Offerings regarding licensure or certification in a specific field or occupation.

      1. General Payment Terms.

      Some features of the Service may require payment of fees. You must promptly pay all fees Fighteck or its affiliates charge and any applicable taxes using a payment method linked to the relevant product or service. You will get the chance to review and agree to the fees and, where applicable, any additional terms and conditions related to your purchase (for example, expiration dates for course entitlements) before making any payments. Unless these Terms state otherwise, we denominate all fees in U.S. Dollars, and they are non-refundable, except as our Refund Policy allows or as the law requires.

      Fighteck has no obligation to edit or control User Content that users upload and is not liable for User Content. However, Fighteck can at any time remove or block User Content that we think violates these Terms, infringes on third-party rights, or is otherwise objectionable. When using the Service, you may encounter User Content from various sources, which might be inaccurate, offensive, or objectionable. You waive any legal or equitable rights or remedies you have against Fighteck concerning User Content. If we receive a notice that User Content allegedly does not meet these Terms, we may investigate and decide whether to remove the User Content, which we reserve the right to do at any time.       When you install our app on your mobile device, you agree to receive push notifications, messages that the app sends to your device even when you are not using the app. If you prefer not to receive them, you can disable notifications in your mobile device’s “settings” page.

      12.4 Repeat Infringers:

      We remove or block access to infringing content and may terminate users who repeatedly infringe. We retain the right to suspend or terminate Accounts at our discretion.

      If notified of content removal, you can send a “Counter Notification” to our Designated Agent with your signature, details of the removed content, a statement under penalty of perjury, and contact information.

      12.6 Content Restoration:

      Upon receipt of a valid Counter Notification, we’ll inform the claimant and restore the content within 10-14 business days unless a court order is obtained.

      1. Indemnity.

      You’re fully responsible for your Service use and must protect and indemnify Fighteck and its entities from third-party claims, liabilities, expenses, and more, including legal fees, arising from: (a) improper Service use; (b) violating these Terms, agreements, or laws; (c) infringing third-party rights; or (d) disputes. We can take control of defense, at our cost, if required, and you must assist.

      1. Disclaimers.

      16.1 Fighteck, 2U, Fighteck Participants, and Other Providers offer the Service and its content “AS IS” and “AS AVAILABLE.” They disclaim all warranties, including implied warranties and do not guarantee uninterrupted, secure, or error-free service.

      16.2 Except for Degree Offerings in Section 4, your participation in Offerings doesn’t grant admission, enrollment, or additional privileges in degree programs.

      16.3 No advice or information from the Service or Fighteck Entities creates warranties beyond these Terms. We’re not liable for any damage or data loss from your use of the Service.

      16.4 These limitations, exclusions, and disclaimers apply to the fullest extent permitted by law and don’t waive any prohibited warranties or rights.

      18.7 Arbitration Relief: The arbitrator can award court-like relief, and Fighteck pays the higher of the award or $10,000. The award is final, with exceptions.

      18.9 Changes to Arbitration: Reject changes within 30 days to terminate your Account and maintain the prior arbitration provision.

When you enroll in any Degree Offering, you must follow Member policies and practices, which may appear in a student handbook or elsewhere. You also face disciplinary action if you fail to adhere to these policies and practices. These Terms do not override any terms, conditions, policies, or practices that the Member providing the Degree Offering sets, and any conflict between these Terms and Member-specific terms, conditions, policies, and practices will always resolve in favor of the Member’s provisions. These Terms do not intend to, and will not, supersede any terms, conditions, policies, or practices that a Member applies to you for any Degree Offering.

      4.2 Fighteck or the relevant Member may collect tuition and fee payments for Degree Offerings, depending on the specific program.

      We encourage you to research independently and decide if the cost of any Degree Offering aligns with your career, personal, and financial goals. Members usually set the costs, such as tuition and fees, for their Degree Offerings, and they may adjust these costs for future academic terms or other relevant periods. You may be eligible for refunds for paid Services as our Refund Policy outlines, or as a Member’s terms and conditions specify for a particular Degree Offering.

      4.3 Professional licensure and certification requirements differ across states and countries, and employers’ job requirements also vary.

      Fighteck does not ensure that you will obtain licensure, certification, or job qualification upon completing a Degree Offering through the Service. You should research, understand, and meet the requirements in the state or country where you work or plan to work. Before enrolling, verify whether the Degree Offering fulfills your academic or professional needs. Also, consider consulting any resources the Member provides about its Degree Offerings regarding licensure or certification in a specific field or occupation.

      1. General Payment Terms.

      Some features of the Service may require payment of fees. You must promptly pay all fees Fighteck or its affiliates charge and any applicable taxes using a payment method linked to the relevant product or service. You will get the chance to review and agree to the fees and, where applicable, any additional terms and conditions related to your purchase (for example, expiration dates for course entitlements) before making any payments. Unless these Terms state otherwise, we denominate all fees in U.S. Dollars, and they are non-refundable, except as our Refund Policy allows or as the law requires.

      5.1 Price.

      Fighteck has the authority to set prices for the Service. We will strive to keep the pricing information on the Service current. We may change the fees for any part of the Service, including adding new fees or charges, by giving you advance notice of these changes. Fighteck alone decides to offer promotional deals with different features and prices to any Fighteck business partners or customers. These promotions, unless offered to you, do not apply to you, and we may withdraw a promotion if we find that you do not qualify. Fighteck or its third-party payment processors include all applicable taxes such as value-added taxes, goods and services taxes, duties, levies, or charges in the fees for the Service, based on the tax laws in your country, unless stated otherwise.

      5.2 Authorization.

      When you make any purchases within the Service, you give Fighteck permission to charge all amounts, including any applicable taxes, as these Terms describe or as Fighteck otherwise publishes. This charge goes to the payment method you have specified in your Account. If you use a credit card for any fees, Fighteck may check if your credit card account has the validity and necessary funds or credit before your purchase to ensure it can cover your purchase.

      5.3 Subscription Offerings.

      Section 5.3 provides additional terms for using our Subscription Offerings.

      For subscription plans via Fighteck for Business, specific arrangement terms apply, not this Section.

      The Service offers subscription plans with automatic recurring payments, including free trials. We specify trial duration, subscription period, and fees upon subscription.

      Paid subscriptions begin after the free trial, renewing automatically unless canceled or terminated.

      By subscribing:

      • We may bill you periodically before the due date.
      • Charges recur on the billing date.
      • Keep payment details updated.
      • To cancel, visit “Orders and subscriptions” > “Manage my subscription” in your account.
      • Cancel pre-renewal to avoid charges or post-trial to prevent initial fees.
      • Help available in Fighteck’s Help Center.
      • Cancelling during a free trial retains access until trial end.
      • Post-trial, access may change. Post-cancellation, access continues until the current period ends, then may change.

      5.4 Delinquent Accounts.

      Fighteck may suspend or terminate your access to the Service, including the fee-based sections, if your Account has any unpaid amounts. A delinquent Account will incur fees or charges related to any chargeback or the collection of the unpaid amount, including collection fees.

      If your payment method fails when a Subscription Fee is due, and you do not correct the payment issue within any grace period Fighteck may offer, Fighteck may suspend your subscription to the relevant Subscription Offerings. Fighteck may then either unenroll you from all Offerings within that Subscription Offering, causing you to lose any progress if you later re-enroll, or change your enrollment from the Certificate Track to the Audit Track.

      1. Licenses.

      6.1 Limited License.

      As long as you comply with these Terms, Fighteck gives you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license solely for your personal, non-commercial use to: (a) install and use one object code copy of any mobile or other downloadable application linked with the Service on a mobile device you own or control, and (b) access and use the Service. For Materials defined in Section 7 (Ownership; Proprietary Rights) within an Offering, this license limits your use to the Materials as part of that Offering.

      6.2 License Restrictions.

      You may not, unless such a restriction is unlawful under applicable law, (a) copy, distribute, display or perform publicly, or create adaptations of the Service; (b) modify the Service; or (c) disrupt or bypass any Service features, including security or access controls. If the law bans you from using the Service, you must not use it.

      6.3 Feedback.

      Fighteck values user feedback. If you provide ideas and suggestions about current functions, issues, or proposed changes or improvements to the Service (“Feedback”), you also give Fighteck an unrestricted, ongoing, irrevocable, non-exclusive, fully-paid, royalty-free right to use the Feedback however we want, including to enhance the Service and develop new products and services. They bear no responsibility for how third-party services use your info or third-party website content. They don’t endorse third-party content or services. After sharing, Fighteck, 2U, and Fighteck Participants lose control, and you assume all risks when using third-party services or linked websites.

      8.2 Third-Party Software

      The Service might contain or use third-party software components available for free under licenses that give broad rights to copy, modify, and distribute those components (“Third-Party Components”). Even though the Service comes with these Terms, nothing in these Terms will prevent or restrict you from getting Third-Party Components under the third-party licenses or limit your use of Third-Party Components under those licenses.

You commit to paying all monies due to any person or entity because of your User Content and Fighteck’s use of the license in this section.

      9.3 Specific Rules for Musical Works and Recording Artists.

      If you are a composer or author of a musical work and you have given non-exclusive rights to a Performing Rights Organization (PRO), you must inform your PRO of the royalty-free license you grant through these Terms to Fighteck. You must ensure you meet your PRO’s reporting obligations. If a music publisher or PRO holds your rights, you need their consent to grant the royalty-free license these Terms describe, or they must enter these Terms with Fighteck. If you are a recording artist under a record label contract, you must make sure your use of the Service meets your contractual obligations to your label, especially if you create new recordings through the Service that your label may claim.         14.2 Termination:

        Breaking the Terms ends your rights and access. Fighteck can terminate at any time, with or without notice. You can end your Account anytime. After termination, certain sections persist. Backup your content; it becomes inaccessible. Don’t re-register if banned.

        Service changes may occur without notice, with no Fighteck liability. Save your content to avoid loss. “Fighteck Participants” include educational entities and personnel.

      1. Indemnity.

      You’re fully responsible for your Service use and must protect and indemnify Fighteck and its entities from third-party claims, liabilities, expenses, and more, including legal fees, arising from: (a) improper Service use; (b) violating these Terms, agreements, or laws; (c) infringing third-party rights; or (d) disputes. We can take control of defense, at our cost, if required, and you must assist.

      1. Disclaimers.

      No Warranties by Fighteck.

      16.1 Fighteck, 2U, Fighteck Participants, and Other Providers offer the Service and its content “AS IS” and “AS AVAILABLE.” They disclaim all warranties, including implied warranties and do not guarantee uninterrupted, secure, or error-free service.

      16.2 Except for Degree Offerings in Section 4, your participation in Offerings doesn’t grant admission, enrollment, or additional privileges in degree programs.

      16.3 No advice or information from the Service or Fighteck Entities creates warranties beyond these Terms. We’re not liable for any damage or data loss from your use of the Service.

      16.4 These limitations, exclusions, and disclaimers apply to the fullest extent permitted by law and don’t waive any prohibited warranties or rights.

      1. Limitation of Liability.

      17.1 Fighteck Entities and Other Providers are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, regardless of the legal theory, even if they knew of such damages.

      17.2 Their liability for Service-related claims is limited to (A) your last 12 months’ payments or (B) US $100, as per Sections 18.5 and 18.7.

      17.3 These limits, warranty disclaimers, and damage exclusions allocate risks, are essential, severable, and apply even if remedies fail.

      Dispute Resolution and Arbitration.

      18.1 You and Fighteck agree to resolve disputes through binding arbitration, excluding certain exceptions, using a neutral arbitrator. This agreement remains valid after these Terms end.

      18.2 Exceptions: Small claims court, government agencies, injunctive relief in court, and intellectual property claims in court are not subject to arbitration.

      18.3 Opt-Out: You can opt out of arbitration within 30 days by sending a letter to Fighteck with your name, email, and an opt-out statement.

      18.4 Arbitrator: Arbitration is conducted by the American Arbitration Association under its rules.

      18.5 Starting Arbitration: Initiate arbitration with a written Notice of Arbitration. Fighteck reimburses fees under $10,000, except in multiple consumer cases.

      18.6 Arbitration Proceedings: Hearings are in your county or state or based on AAA Rules.

      18.7 Arbitration Relief: The arbitrator can award court-like relief, and Fighteck pays the higher of the award or $10,000. The award is final, with exceptions.

      18.8 No Class Actions: Claims are in an individual capacity, not as part of a class action.

      18.9 Changes to Arbitration: Reject changes within 30 days to terminate your Account and maintain the prior arbitration provision.

      1. Miscellaneous.

      19.1 General Terms.

      These Terms, Privacy Policy, Honor Code, and referenced agreements are the exclusive agreement for your Service use. No transfer without our consent; we can transfer anytime. Our non-enforcement doesn’t waive future action. Section headers are for convenience. “Including” means “including but not limited to.” Invalid parts are applied as much as possible; the rest stands.

      19.2 Governing Law.

      These Terms are governed by Maryland law, with exclusive jurisdiction in Prince George’s County, Maryland for allowed legal actions. The Service operates from Maryland and may not be suitable or accessible elsewhere.

      The Privacy Policy, which we update periodically, details how we handle your personal information. We will notify you of material changes through the Fighteck Site or other means. The Privacy Policy is part of these Terms.

      19.5 Additional Terms.

      Your use of the Service is subject to all other terms, policies, rules, or guidelines we may provide or link to from the Service (“Additional Terms”), which are part of these Terms.

      19.6 Consent to Electronic Communications.

      By using the Service, you agree to receive electronic communications from us as described in Section 10 (Communications) and the Privacy Policy. You accept that electronic communications we send meet any legal requirement that such communications be in writing.

      20. Notice Regarding Apple.

      For iOS app users: These Terms are with edX, not Apple. Apple isn’t responsible for the Service or support. If there’s a warranty issue, contact Apple for a refund. Apple has no other warranty obligations. Claims, including product liability, aren’t handled by Apple. You must adhere to third-party terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you.
